Copyright & Intellectual Property Policy
Last Updated: 30 August 2026
1. Copyright ownership
Unless expressly stated otherwise, copyright in original artistic works created by Rachel Ford belongs to Rachel Ford.
The creator of an artistic work is generally the first owner of copyright unless a legal exception or valid transfer applies.
2. Physical ownership and copyright are separate
Buying an original artwork gives the purchaser ownership of the physical artwork.
It does not transfer copyright.
Buying a print gives the purchaser ownership of that physical print.
It does not transfer copyright.
Copyright can only be transferred where a valid written assignment or other lawful transfer is made.
3. Website content
The Rachel Ford in Colour website contains material protected by copyright and other intellectual property rights.
This may include:
• original artwork;
• artwork photographs;
• close-up images;
• product photographs;
• graphics;
• logo material;
• product descriptions;
• written website content;
• marketing materials;
• layouts; and
• other original creative material.
4. Personal website use
Visitors may view the website for ordinary personal use.
Access to the website does not grant a licence to reproduce or commercially exploit its content.
5. Copying artwork
Without Rachel Ford's written permission or a legal exception, you must not:
• copy artwork;
• reproduce artwork;
• create derivative commercial reproductions;
• make prints from website images;
• frame a website printout as a substitute artwork;
• distribute digital reproductions;
• sell digital copies;
• upload high-resolution reproductions for reuse; or
• authorise another person to do so.
6. Printing website material
You may print ordinary website pages for genuine personal reference.
This does not give permission to print the artwork image itself for display, framing, resale, commercial use or redistribution.
7. Social media
A customer may photograph purchased artwork for ordinary private use.
Where the artwork itself is clearly reproduced and the image is to be published publicly, Rachel Ford in Colour asks that the customer obtains written permission from Rachel Ford first.
Permission may include conditions concerning:
• platform;
• attribution;
• cropping;
• editing;
• commercial use; and
• duration.
8. Commercial use
No commercial licence is granted simply because a person owns the physical artwork.
Without written permission, artwork must not be used for:
• advertising;
• branding;
• websites;
• packaging;
• merchandise;
• clothing;
• stationery;
• book covers;
• album artwork;
• products for resale;
• commercial social media;
• promotional campaigns; or
• another commercial purpose.
9. Commercial licensing
A business or individual who wants to use Rachel Ford's work commercially must obtain a separate written licence.
A licence may set out:
• permitted use;
• territory;
• duration;
• reproduction quantity;
• platform;
• media;
• fee;
• exclusivity;
• attribution; and
• restrictions.
No commercial licence should be assumed from silence.
10. Prints and reproductions
Only Rachel Ford or a person authorised by Rachel Ford may commercially produce or sell reproductions of Rachel Ford's artwork.
A purchaser of an original artwork does not gain a right to create prints from it.
11. Artificial intelligence
Rachel Ford does not grant permission for her artwork, images or protected website content to be used for generative AI or machine-learning purposes.
This includes unauthorised use for:
• model training;
• fine-tuning;
• style replication;
• machine-learning datasets;
• image datasets;
• embeddings;
• synthetic data generation;
• model evaluation;
• automated commercial analysis; or
• commercial AI research.
12. Scraping and automated extraction
Except for lawful ordinary search-engine indexing, automated extraction of Rachel Ford in Colour content is prohibited where it is intended to copy, reproduce, republish, analyse commercially or create datasets from the protected material without permission.
This includes:
• scraping;
• crawling for dataset creation;
• bulk image downloading;
• bulk product-description extraction;
• catalogue replication; and
• automated harvesting.
13. NFTs and tokenisation
Ownership of an original artwork or print does not grant a right to mint, tokenise or sell an NFT or comparable digital asset representing Rachel Ford's artwork.
Written permission is required.
14. Resale of the physical artwork
A lawful owner may resell or otherwise dispose of the physical artwork subject to applicable law.
The seller must not imply that:
• Rachel Ford endorses the resale;
• Rachel Ford guarantees the reseller;
• Rachel Ford has re-authenticated the work;
• the resale is an official Rachel Ford in Colour sale; or
• Rachel Ford approved alterations where she did not.
15. Copyright on resale
Resale of the physical object does not transfer Rachel Ford's copyright.
A reseller cannot lawfully create additional copies merely because they own the original object.
16. Artist's Resale Right
A qualifying future resale through an art-market professional may be subject to the UK's Artist's Resale Right regime.
Any right that applies by law remains reserved.
17. Moral rights
Rachel Ford reserves applicable moral rights in her work.
These may include the right to be identified as author where asserted and applicable, and the right to object to derogatory treatment where the legal conditions are met.
18. Altered artwork
A person should not materially alter, overpaint or modify Rachel Ford's artwork and then represent the altered work as an unaltered original by Rachel Ford.
Alteration may affect condition, value, provenance and attribution.
19. Customer photographs
A customer who sends Rachel Ford in Colour a photograph retains their own rights in that photograph unless otherwise agreed.
Rachel Ford in Colour will obtain permission before using a customer photograph for website, social media, advertising or printed marketing.
20. Copyright infringement
Where Rachel Ford reasonably believes her work has been infringed, Rachel Ford in Colour may take proportionate action.
This may include:
• requesting removal;
• contacting a website or marketplace;
• submitting a copyright complaint;
• sending a cease-and-desist request;
