Terms & Conditions
Last Updated: 30 August 2026

1. About these Terms

These Terms & Conditions govern your use of the Rachel Ford in Colour website and any order that you place with Rachel Ford in Colour.

Please read these Terms carefully before placing an order.

By placing an order, you agree to these Terms.

Nothing in these Terms excludes, restricts or replaces any statutory rights that you have as a consumer under the laws of England and Wales or any other mandatory consumer protection that applies to you.

2. About Rachel Ford in Colour

Rachel Ford in Colour is an independent art business operated by Rachel Ford as a sole trader in England.

Rachel Ford in Colour sells artwork created by Rachel Ford.

The business currently sells:

• original artwork;

• framed and unframed original artwork;

• standard art prints;

• framed prints where offered; and

• limited-edition prints where expressly described as such.

Rachel Ford in Colour does not currently sell commissioned artwork through the normal online shop.

3. Who can buy from the website

You must be aged 18 or over to place an order.

By placing an order, you confirm that:

• you are at least 18 years old;

• you have legal capacity to enter into a contract;

• the information you provide is complete and accurate;

• you are authorised to use the payment method supplied;

• you are purchasing for lawful purposes; and

• you are not attempting to disguise the identity of the true purchaser or payer.

Rachel Ford in Colour may refuse or cancel an order where there is a reasonable concern about age, authority, fraud, financial crime, payment security or unlawful activity.

4. Sales territory

Rachel Ford in Colour currently accepts orders for delivery within Great Britain only.

This means delivery is currently available to England, Scotland and Wales.

Delivery is not currently available to Northern Ireland, the Channel Islands, the Isle of Man or countries outside the United Kingdom.

Rachel Ford in Colour may change the delivery area in future. Any change will be shown on the website before an order is placed.

5. Original artwork

Unless a product listing states otherwise, an original artwork is a unique physical work created by Rachel Ford.

An original artwork may contain characteristics that form part of the artistic process. These may include visible brushwork, texture, layering, surface variation, irregular marks, natural differences in materials and other intentional characteristics.

These characteristics are not defects where they form part of the intended artwork.

Where a one-off original has been sold, Rachel Ford in Colour cannot guarantee that an identical replacement can be produced.

A replacement, recreation or similar work will never be represented as the same original artwork.

6. Prints

A print is a reproduction of an original work by Rachel Ford.

The product listing will make clear where an item is a print rather than an original.

Printed colours, texture and surface appearance can differ from the original artwork because of printing processes, paper, substrate, scale, colour management and finishing methods.

Normal production variation does not make a print defective where it remains consistent with its description and is of satisfactory quality.

7. Limited-edition prints

A product will only be described as a limited edition where the number or availability of reproductions is genuinely limited.

The relevant product listing should state the edition size or other genuine limitation.

A limited-edition print is not necessarily numbered, signed or supplied with a Certificate of Authenticity unless the product description expressly says that it is.

Rachel Ford in Colour will not knowingly describe an unrestricted reproduction as a limited edition.

8. Framed artwork

Where a listing states that an artwork is sold framed, the frame forms part of the product.

Frames may contain natural or manufactured materials. Small natural variations in wood grain, finish or construction may occur.

Room-setting photographs and staged interior images are illustrative unless the written listing expressly states that the room, furniture or other decorative items are included.

The written product description takes priority when determining exactly what is being sold.

9. Product photographs and colour

Rachel Ford in Colour takes reasonable care to present artwork accurately.

Colour may appear differently depending on the screen, device, brightness, display calibration, browser, room lighting and photographic conditions used.

Rachel Ford in Colour cannot guarantee that a digital screen will reproduce every colour exactly as it appears on the physical artwork.

This does not affect your rights where an item is materially different from its description.

10. Dimensions and measurements

Measurements are provided as accurately as reasonably possible.

Minor tolerances may occur, especially where artwork or framing is handmade.

If an exact measurement is critical because an artwork must fit a particular wall, alcove, frame or space, contact Rachel Ford in Colour before ordering.

11. Product information

Rachel Ford in Colour aims to provide clear and accurate product information.

Product information may include:

• title;

• medium;

• dimensions;

• orientation;

• original or print status;

• framing;

• material;

• price;

• stock availability;

• care information; and

• delivery information.

Rachel Ford in Colour may correct an obvious typographical or factual error.

Rachel Ford in Colour will not knowingly substitute a materially different product without your agreement.

12. Availability

All products are subject to availability.

Original artwork may be unique and may occasionally be displayed or offered through another legitimate sales channel.

An item appearing as available online does not guarantee availability until the order is accepted.

If an artwork has already sold, Rachel Ford in Colour will not substitute another artwork without your agreement.

If payment has already been received for an unavailable product, the relevant amount will be refunded.

13. Prices

All prices are stated in pounds sterling, GBP (£).

Rachel Ford in Colour is not currently registered for VAT.

VAT is therefore not currently added by Rachel Ford in Colour to advertised prices.

Delivery charges are additional unless the product page expressly states that delivery is included.

Any mandatory charge payable to Rachel Ford in Colour will be disclosed before you place the order.

14. Seasonal sales and reduced prices

Rachel Ford in Colour may run seasonal sales or temporary promotions.

A reduction in price does not remove statutory consumer rights.

Sale products remain subject to applicable rights concerning faulty goods, misdescribed goods and distance-selling cancellation rights where those rights apply.

15. Obvious pricing errors

Rachel Ford in Colour takes reasonable care when setting prices.

Where there is an obvious pricing error that could reasonably have been recognised as a mistake, Rachel Ford in Colour may contact you before accepting or fulfilling the order.

Rachel Ford in Colour will not simply charge a higher amount without your agreement.

If the order is cancelled because of an obvious pricing error, any amount already paid for that order will be refunded.

16. Placing an order

Before submitting an order, you should check:

• the artwork selected;

• whether it is an original or a print;

• dimensions;

• framing;

• quantity;

• price;

• delivery charge;

• delivery address;

• contact information; and

• payment information.

The website should provide a reasonable opportunity to correct errors before payment.

17. Contract formation

An automated acknowledgement that an order has been received does not necessarily mean that the order has been accepted.

A contract is formed when Rachel Ford in Colour accepts the order.

Acceptance may occur through an express order acceptance, dispatch confirmation or another clear confirmation that the order has been accepted and is being fulfilled.

Rachel Ford in Colour may refuse an order before acceptance.

Reasons may include:

• the item having already sold;

• an obvious pricing error;

• failed payment;

• suspected fraud;

• suspected financial crime;

• inability to complete reasonable high-value transaction checks;

• delivery outside the service area;

• suspected misuse of the website; or

• another lawful reason.

18. Payment methods

Payment methods may include, where enabled:

• PayPal;

• Apple Pay;

• Google Pay;

• payment card services available through Wix or its payment partners;

• bank transfer; and

• cash by prior agreement.

The payment methods actually available will be those displayed at checkout or expressly agreed with Rachel Ford in Colour.

19. Payment security

Payments may be processed by third-party payment providers.

Rachel Ford in Colour does not normally need to receive or retain complete card security credentials where a payment provider processes the transaction.

Never send a full card number, card security code, password or online banking password by ordinary email, WhatsApp or a website contact form.

20. Bank transfer

Where bank transfer is accepted, payment must be made to the bank details supplied directly by Rachel Ford in Colour.

An artwork may remain unreserved or only provisionally reserved until cleared funds are received.

If you receive an unexpected message saying that bank details have changed, verify the change using established contact details before sending money.

Rachel Ford in Colour will not ask you to transfer money to an unrelated third party.

21. Cash payments

Cash is accepted only by prior agreement.

Rachel Ford in Colour reserves the right to refuse cash or require a traceable electronic payment method.

Rachel Ford in Colour will not accept cash payments totalling £10,000 or more for a single transaction or linked transactions unless all legal High Value Dealer requirements that apply have been completed before the payment is accepted.

Attempts to split a cash transaction to avoid a legal threshold may result in refusal of the transaction.

22. High-value transactions

High-value or unusual transactions may receive additional checks even where formal anti-money laundering customer due diligence is not legally required.

Rachel Ford in Colour may request proportionate information including:

• legal name;

• address;

• proof of identity;

• proof of address;

• confirmation of the payer;

• confirmation of the payment method;

• source-of-funds information;

• explanation of a third-party payment; or

• another reasonable verification item.

An order may be delayed, refused or cancelled where there is a genuine fraud, sanctions or financial-crime concern.

23. Delivery

Delivery is governed by the separate Delivery Policy.

Delivery charges apply unless expressly stated otherwise.

Rachel Ford in Colour may use tracked, signed-for, insured or specialist delivery depending on the value, size and fragility of the artwork.

24. Collection

Collection may be offered by prior arrangement.

The business address is not an unrestricted walk-in retail premises.

Do not attend for collection without an agreed appointment.

Rachel Ford in Colour may require order confirmation, proof of identity, confirmation of payment and a signature before releasing high-value artwork.

25. Risk and ownership of the physical goods

Where Rachel Ford in Colour arranges delivery to a consumer, risk normally passes when the customer, or a person identified by the customer, takes physical possession of the goods.

Ownership of the physical artwork does not transfer copyright or other intellectual property rights.

26. Returns and cancellation

Online cancellation, returns, refunds and faulty-goods rights are governed by the separate Returns, Refunds & Cancellation Policy.

Nothing in these Terms removes any statutory consumer right.

27. Copyright

Unless Rachel Ford signs a separate written copyright assignment, copyright in Rachel Ford's artwork remains with Rachel Ford.

Buying an original artwork transfers ownership of the physical object only.

Buying a print transfers ownership of that physical print only.

Neither purchase transfers copyright.

Further rules are contained in the separate Copyright & Intellectual Property Policy.

28. Photographing artwork

You may photograph purchased artwork for ordinary private and domestic purposes.

Where you want to publish a clear reproduction of the artwork itself, including on social media, Rachel Ford in Colour asks that you obtain written permission from Rachel Ford first.

Permission may be subject to reasonable conditions such as attribution, platform, purpose and restrictions on commercial use.

Incidental appearance of artwork in ordinary private photography will be treated reasonably and proportionately.

29. Commercial reproduction

Without written permission from Rachel Ford, you must not reproduce artwork for commercial purposes.

This includes using artwork to create or promote:

• clothing;

• stationery;

• websites;

• advertising;

• digital products;

• logos;

• branding;

• NFTs;

• commercial datasets; or

• artificial intelligence training datasets.

30. Artificial intelligence, scraping and automated extraction

Rachel Ford does not grant permission for her artwork, website images or protected written content to be scraped, copied or harvested for generative AI, machine learning, style replication, dataset creation or commercial automated analysis.

Normal search-engine indexing is not prohibited where it is carried out lawfully and for ordinary indexing purposes.

31. Resale of physical artwork

A person who lawfully owns a physical artwork may dispose of or resell that physical item subject to applicable law.

A resale does not transfer Rachel Ford's copyright.

A reseller must not falsely imply that Rachel Ford endorses the resale, guarantees the seller, has re-authenticated the item or has approved alterations where she has not done so.

Any Artist's Resale Right that applies by law remains unaffected.

32. Customer accounts

Customers may be able to create an account.

Guest checkout may also be available.

If you create an account, you must keep account credentials secure and provide accurate information.

You must not use another person's account without permission.

Rachel Ford in Colour may suspend or close an account where reasonably necessary for security, fraud prevention, abuse or breach of these Terms.

33. Reviews and comments

Reviews and comments must reflect a genuine experience.

You must not submit fake, misleading, abusive, unlawful or impersonated content.

Rachel Ford in Colour may moderate content under its separate Customer Review Policy.

Genuine criticism will not be removed simply because it is negative.

34. Customer photographs

A customer may voluntarily send photographs showing Rachel Ford artwork in their home or another setting.

Sending a photograph does not automatically give Rachel Ford in Colour permission to publish or advertise with it.

Separate permission will be obtained before a customer photograph is reused for the website, social media, advertising or printed marketing.

35. Acceptable website use

You must not use the website to:

• commit fraud;

• attempt unauthorised access;

• introduce malware;

• interfere with website security;

• harvest personal data unlawfully;

• place deliberately false orders;

• misuse payment systems;

• impersonate another person;

• infringe intellectual property rights;

• interfere with other customers; or

• commit any unlawful act.

36. Website availability

Rachel Ford in Colour aims to keep the website available and accurate.

Continuous or uninterrupted availability is not guaranteed.

The website may be temporarily unavailable because of maintenance, technical faults, security incidents, hosting failure, third-party service disruption or events outside reasonable control.

37. Third-party services

The website may use third-party services for hosting, payments, analytics, communications, reviews, maps, embedded media and delivery.

Those providers may have their own terms and privacy policies.

A link to another website does not mean that Rachel Ford in Colour endorses all content on that website.

38. Events outside reasonable control

Rachel Ford in Colour is not responsible for delay caused by events outside reasonable control where the law permits this.

Examples may include severe weather, major transport disruption, courier failure, fire, flooding, major network failure, civil emergency or government restriction.

Rachel Ford in Colour will take reasonable steps to reduce disruption and keep affected customers informed.

39. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Nothing excludes liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where liability cannot legally be excluded.

Nothing in these Terms removes rights that a consumer cannot legally waive.

41. Changes to these Terms

Rachel Ford in Colour may update these Terms to reflect changes in law, business operations, products, payment methods, website functionality or internal procedures.

The Terms that apply to an accepted order will normally be those in force when that order was placed.

42. Severability

If a court or other competent authority decides that a provision is invalid or unenforceable, the remaining provisions will continue to apply.

43. No waiver

A delay in exercising a right does not automatically mean that the right has been waived.

44. Governing law
